LIMITED WARRANTY POLICY 

 

DAIKIN AIRCONDITIONING PUERTO RICO INC. ("DAIKIN PR") offers Buyers ("Buyer") a limited warranty on the products it offers through https://shop.daikinlatam.com/PuertoRico/ (hereinafter referred to as "DAIKIN PR WEBSITE"), under the terms and conditions outlined in this policy. When Buyer purchases DAIKIN PR products through the DAIKIN PR WEBSITE, it is understood that Buyer accepts and acknowledges that this policy shall apply to its purchase. 

 

 

1.               LIMITED WARRANTY

 

DAIKIN PR offers a limited warranty concerning the products it sells through the DAIKIN PR WEBSITE ("Products"), which shall have a term of 12 months from the date of delivery. Subject to the limitations outlined in this policy, solely for those instances where DAIKIN PR in its sole discretion determines that the Products sold have a manufacturing defect in certain materials or components, DAIKIN PR warrants that only those replacement parts or components that DAIKIN PR in its sole discretion determines to be covered under the warranty will be shipped to Buyer. Replacement parts or components refer to, compressors, condenser coils, relays, and fan motors. For the warranty to be effective, the Products must have been installed, operated, and maintained under normal conditions, and per the manufacturer's instructions. 

 

To claim the application of this warranty, the Buyer must register the Product sold on the website https://daikinlatam.com/warranty/indexEsp.htmlat the latest within thirty (30) days from the date of the confirmation of the purchase order of the Product. 

 

Also, in case the Buyer needs to claim the application of the warranty, the Buyer shall send an email to soporteonline@daikinapplied.com, with the following information: 

 

a.      Buyer's information, such as, full name and surname of the person, name of the business name and/or corporate name and/or name of the corporate entity that purchased the Product, email and cell phone number or contact telephone number, physical and mailing address, and any other information deemed necessary to be able to identify him/her/it as a Buyer in DAIKIN PR's records and/or systems. 

 

b.      Description of the Product purchased, including its make, model, and BTU of the Product. 

 

c.      Purchase Order Number and Date of Purchase of the Product. 

 

d.      Describe the problem the Product is experiencing. 

 

e.      Copy of the Final Purchase Order and Purchase Order confirmation email. 

 

f.       Proof of Warranty Registration. 

 

Within seventy-two (72) hours of receipt of the warranty claim, DAIKIN PR and/or any designated agent will contact Buyer to confirm receipt of the claim and the information provided in the claim and assign a claim number. 

 

In addition, within approximately five (5) business days of the request, DAIKIN PR will notify Buyer of the outcome of the evaluation of its request as to the applicability of the warranty and will determine the course of action to be taken to honor the warranty per the provisions of this Policy. If DAIKIN PR determines that the request is not covered by the warranty provided herein, DAIKIN PR will notify Buyer of such determination by e-mail, stating the basis for its determination. 

 

If DAIKIN PR determines that the warranty provided herein applies, Buyer shall make the part or component to be replaced available to DAIKIN PR at the same location where the Product was delivered and/or installed by DAIKIN PR upon purchase. The cost of pick-up and delivery of the part or component to be replaced and/or the replacement part or component under this warranty shall be borne and coordinated by DAIKIN PR. 

 

Replacement parts and/or components under this warranty will be delivered to the location where the Product was installed through DAIKIN PR and/or to where it was delivered if not installed through DAIKIN PR. 

 

 

2.               EXCLUSIONS  

 

This warranty does not include and/or excludes from its coverage: 

 

        Any other expenses associated with the replacement service of parts or components authorized under the warranty, including but not limited to labor necessary to materialize the replacement. 

        Refrigerants, fluids, oils, filters, and/or other items required and consumed by the unit through ordinary wear and tear. 

        Costs of electricity, fuel, or increase in these costs for any reason. 

        Accommodation or transportation of the technician required to replace the unit and/or part. 

 

This Warranty shall NOT apply to Products that have not been purchased through the DAIKIN PR WEBSITE; to Products that have been damaged during improper operation and/or have been altered by anyone other than DAIKIN PR and/or its authorized representative; to Products that have been opened, disassembled, repaired or altered by anyone other than DAIKIN PR and/or its authorized representative; to Products that have been subjected to misuse, neglect, accidents, use or service damage; to Products that have been turned on and/or started, operated, and/or installed contrary to DAIKIN PR's instructions; to Products that have been exposed to the action of the elements such as, atmospheric events, water, dust, wind, fire, pollutants, contaminants, corrosive agents, chemicals or minerals, or as a result or effect, for example, of the source of water or electricity supply; to Products that have not been fully paid for by the Buyer, and/or have suffered damage during transportation by the Buyer itself to the location where the Product would be installed. 

 

3.               BUYER'S RESPONSIBILITY 

 

It is the Buyer's responsibility to use and maintain the Products according to the specifications and recommendations of DAIKIN PR and/or the manufacturer. The Buyer must provide the maintenance required for the Product to function in optimal conditions. Failure of the Buyer to comply with its responsibility to use and/or maintain the required maintenance may result in the inapplicability of the warranty provided herein. 

 

4.               LIMITATION OF LIABILITY 

 

DAIKIN PR's liability under this warranty shall be limited to the lesser cost between correcting the defects in the Products or the original purchase price of the Products. 

 

THIS WARRANTY CONSTITUTES DAIKIN PR'S SOLE LIABILITY AND THE EXCLUSIVE REMEDY PROVIDED TO THE BUYER. THIS WARRANTY IS GIVEN IN PLACE OF ALL OTHER WARRANTIES, WHETHER WRITTEN, ORAL, EXPRESSED, OR IMPLIED, INCLUDING WARRANTY OF TITLE, AGAINST LIEN, INFRINGEMENT, WARRANTY OF MERCHANTABILITY, AND WARRANTY OF FITNESS OR FITNESS FOR A PARTICULAR PURPOSE. 

 

IN NO EVENT AND UNDER NO CIRCUMSTANCES SHALL DAIKIN PR AND/OR ANY OF ITS PARENT ENTITIES, AFFILIATES, SHAREHOLDERS, MEMBERS IN INTEREST, DIRECTORS, EMPLOYEES, AND/OR OFFICERS BE LIABLE TO PURCHASER OR ANY THIRD PARTY FOR ANY INCIDENTAL OR CONSEQUENTIAL, SPECIAL, INCIDENTAL, CONSEQUENTIAL, CONTINGENT OR INDIRECT DAMAGES OR LOSSES, INCLUDING, BUT NOT LIMITED TO, LOSS OF USE, REVENUE, PROFITS, LOST PROFITS OR OTHER DAMAGES FOR BUSINESS INTERRUPTION, FOR ANY REASON, REGARDLESS OF WHETHER THE THEORY IS BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE OR STRICT LIABILITY IN TORT, EVEN IF THE DAMAGES WERE OR COULD HAVE BEEN FORESEEN.
